Official Rules
ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED.
1. Eligibility. Subject to the additional restrictions below, the Frightsight.com Costume Contest 2008 (the “Contest”) is open to U.S. residents (excluding Puerto Rico), i.e. infants, ages 6m-3; kids, ages 4-8; teens, ages 9-15; adults, ages 16+ and pets. Entries for pets must be submitted by legal owner and for participants under 18 years of age by parent or legal guardian. Employees of The Blade, J. Foster Jewelers, DelTaco, Libbey Glass, Costume Holiday House, White House Christmas Tree Farm, The Corn Maze, the Butterfly House, Chainsaw Creek, Major Magic’s, Car Stereo One and each of their respective affiliated companies, their advertising and promotional agencies, and the immediate family members of, and any persons domiciled with any such employees, are not eligible to enter or to win.
2. Contest Deadline: Contest ends at 11:59 p.m. (E.S.T.) November 7, 2008.
3. How to Enter. Enter by clicking on the “Enter Costume Contest” button above and fill out the form. Include name of entrant; or name of entrant’s parent or guardian (if entrant is under 18 years of age); and daytime phone number. (The Blade will contact entrant and verify age, address and other pertinent information as well as parental consent for
entrants under 18 years of age). A photo of the entrant in his or her costume will also be required and a field will be included in the form to submit photo. Photo should be in gif or jpeg format with 200 DPI resolution or less. Most digital pictures taken in the mid-to-high quality camera setting will be fine. Poor quality photos of either type will not be accepted. Only one photo and entry per person. Entries with incomplete or incorrect information will not be accepted. All photos become property of The Blade, and will not be returned. Copyrighted photos must be accompanied by a photographer’s release. Submissions must be received by 12:00 a.m., November 7, 2008.
Sponsor reserves the right to verify proof of age. No mail-in or in-person entries will be accepted. In addition, purchasers of a print ad featuring a photo of their costume for display in the Classifieds section of The Blade will automatically be entered in the contest. However, no purchase is necessary to enter. Specify “Online Only” to have photo featured on frightsight.com for no charge. Sponsors will not be responsible for incomplete, lost, late, misdirected or unintelligible entries (either photos or accompanying information) or for failure to receive entries due to transmission failures or technical failures of any kind, including, without limitation, malfunctioning of any network, hardware or software, whether originating with sender or sponsor. In the event of a dispute, all online entries will be deemed to have been submitted by the owner of the ISP account from which they were sent. For these purposes, an ISP account holder shall mean the natural person assigned to such ISP account by the Internet access provider, online service provider or other organization responsible for assigning ISP addresses for the domain associated with such ISP account. All entries become property of sponsor and none will be returned.
Any questions regarding the number of entries submitted or the owner of an ISP account shall be determined by sponsor in its sole discretion, and sponsor reserves the right to disqualify any entries by persons determined to be tampering with or abusing any aspect of the contest.
4. Prizes. Top winner in each category will be featured on area billboards following the contest and will receive a variety of gifts from the contest sponsors, including Car Stereo One Gift Certificates, Pandora Bracelets from J. Foster Jewelers, DelTaco Gift Certificates, Major Magic’s Gift Certificates, Gifts from Libbey Glass, Costume Holiday House Gift Certificates, a Christmas tree from White House Christmas Tree Farm.
5. Winner Selection. The Blade digital marketing creative team will review all entries and select winners based on costume creativity, originality and quality of execution. Winners will be selected on or about November 13, 2008. Odds of winning depend on the number of eligible entries received. Winners will be acknowledged in print in The Blade and online at www.toledoblade.com. Top winner in each age group will be featured in an outdoor billboard.
6. Winner Notification and Acceptance. Winners will be notified on or about November 17, 2008, at the telephone number provided on each winner’s entry. Sponsor will call during regular business hours. Failure to reach winner during regular business hours by phone may result in disqualification of winner, forfeiture of his or her interest in all prizes, and selection of a substitute winner from among all remaining eligible entries. Photos of winners will be displayed for one week. For winners under the age of 18 to appear on billboards, a release form granting permission must be signed by parent or legal guardian. A valid photo identification of the parent or guardian may be required. Prizes are nonassignable and nontransferable. No substitutions allowed by winner. Prizes and individual components of prize packages are subject to availability and sponsor reserves the right to substitute prizes of equal or greater value. The winner is solely responsible for reporting and payment of any taxes on prizes. The winner may be required to complete an affidavit of eligibility/liability and publicity release (except where prohibited by law) which must be returned within five (5) days of date of personal delivery or date of postmark. Failure to sign and return the affidavit or release within five (5) days, or to comply with any term or condition of these Official Rules, may result in a winner’s disqualification, the forfeiture of his or her interest in the prize, and the award of the prize to a substitute winner. Except where prohibited, acceptance of any prize constitutes winner’s consent to the publication of his or her name, biographical information and likeness in any media, including on the Internet, for any commercial or promotional purpose, without limitation or further compensation. Prizes not won and claimed by eligible winners in accordance with these Official Rules will not be awarded and will remain the property of sponsor.
7. Participation. By participating, entrants agree to be bound by these Official Rules and the decisions of sponsor. Sponsor reserves the right to disqualify persons found tampering with or otherwise abusing any aspect of this contest as solely determined by sponsor. Sponsor also reserves the right to reject photos of costumes it deems unsuitable for audiences of all ages. In the event the contest is compromised by a virus, non-authorized human intervention, tampering or other causes beyond the reasonable control of sponsor which corrupts or impairs the administration, security, fairness or proper operation of the contest, sponsor reserves the right in its sole discretion to suspend, modify or terminate the contest. Should the contest be terminated prior to the stated expiration date, sponsor reserves the right to award prizes based on the entries received before the termination date.
8. Sponsor. The decisions of the sponsor regarding the selection of winners and all other aspects of the contest shall be final and binding in all respects. Sponsor will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the contest.
